This study aims at ascertaining the existence of an organic legal policy in marriage matters, one which was followed by Roman Emperors in the IV and V centuries, in particular by Constantine. It is also aimed at showing that this policy corresponded to Christian ideas as expressed by various Church Fathers. Neurophysiological studies in monkeys and neuroimaging studies in humans support a model of empathy according to which there exists a shared code between perception and production of emotion. The neural circuitry critical to this mechanism is composed of frontal and parietal areas matching the observation and execution of action, and interacting heavily with the superior temporal cortex. Further, this cortical system is linked to the limbic system by means of an anterior sector of the human insular lobe.

Utilising science and technology to maximize human performance is often an essential feature of military activity. This can often be focused on mission success rather than just the welfare of the individuals involved. This tension has the potential to threaten the autonomy of soldiers and military physicians around the taking or administering of enhancement neurotechnologies (e.g., pills, neural implants, and neuroprostheses). The Hybrid Framework was proposed by academic researchers working in the U.S. context and comprises “rules” for military neuroenhancement (e.g., (...) ensuring transparency and maintaining dignity of the warfighter). Integrating traditional bioethical perspectives with the unique requirements of the military environment, it has been referenced by military/government agencies tasked with writing official ethical frameworks. Our two-part investigation explored the ethical dimensions of military neuroenhancements with military officers – those most likely to be making decisions in this area in the future. In three workshops, structured around the Hybrid Framework, we explored what they thought about the ethical issues of enhancement neurotechnologies. From these findings, we conducted a survey (N = 332) to probe the extent of rule endorsement. Results show high levels of endorsement for a warfighter’s decision-making autonomy, but lower support for the view that enhanced warfighters would pose a danger to society after service. By examining the endorsement of concrete decision-making guidelines, we provide an overview of how military officers might, in practice, resolve tensions between competing values or higher-level principles. Our results suggest that the military context demands a recontextualisation of the relationship between military and civilian ethics. (shrink)

It proposes a reconstruction of Matěj’s academic career and sheds light on the role he played in the late 14th and early 15th century in the reception and development of Wyclif’s metaphysical views in Prague. In particular, Matěj’s views on creatural perfection are taken into account, as they are presented in a quaestio ascribed to Matěj by a marginal note in the (...) only extant manuscript copy, and edited in the appendix. This article takes issue with the most authoritative argument for the commonplace that John Wyclif was an extreme determinist: he denied distinctions between divine ideas and God’s metaphysical constituents and between ideas as principle of divine cognition of creatures and as models for their production ad extra ; since as a constituent of God’s essence every divine idea is absolutely necessary, and every idea is unfailingly a pattern for creation, therefore God cannot but create anything He can think of. This (...) paper argues against the premise that Wyclif never distinguished rationes and exemplaria by examining significant excerpts from Wyclif’s edited and unedited academic writings in which the distinction is assumed or discussed. Wyclif maintains that there are more ideas in God than created essences ad extra, and that God’s absolute power covers more than His ordained power does. To stress that not every divine idea is automatically a model for creation, Wyclif sometimes includes in his standard taxonomy of being a hitherto unnoticed level, the esse intentionale, which is eternal and ad intra, like the esse intelligibile, but contingent, the kind of being in which something participates as the result of God’s free choice to bring it into existence ad extra at the due time. La riflessione del maestro inglese può senz’altro essere considerata per molti versi forte: basti pensare alla piena fiducia riposta nella convergenza di ragione e fede e nella sinergia di metafisica realista e logica della scrittura. Tuttavia, non mancano tracce di debolezza: il discorso teologico del primo Wyclif non solo è più complesso e articolato di quanto non si sia soliti pensare, ma oltretutto sembra condurre a conclusioni ben lontane dall’affermazione estrema e urtante di un unico partito possibile per Dio e (...) per l’uomo. Quanto alle formulazioni più mature, oltre alla possibilità di rintracciare indizi di debolezza nello spirito delle tesi giovanili, sembra anche attestabile la presenza di tracce di indebolimento: questo è il bilancio da trarre circa gli interventi correttivi cui Wyclif sottopose le proprie dottrine teologiche, private con il procedere degli anni del sostegno garantito dai ben congegnati argomenti filosofici.La stessa ricezione del suo pensiero da parte della tradizione può dirsi debole, viziata da fraintendimenti e da letture unilaterali, nonché spesso priva del conforto di riscontri testuali.Il ritratto ben noto del riformatore inglese – alla luce di quanto detto sin qui – reclama forse un ricorso più convinto al chiaro-scuro. Basti pensare al dubbio circa l’efficacia del tentativo proposto proprio nel giovanile De universalibus, così come nel De dominio divino, di una conciliazione tra la necessità degli eventi futuri quoad prescienciam Dei e la libertà umana di determinare le proprie azioni, che pure sembrerebbe suffragata da molte evidenze testuali.Un modo, questo, per dire che la ballata leggendaria di un Wyclif determinista continuerà ancora a essere cantata. This paper deals with three references found in John Wyclif’s unpublished De scientia Dei to a certain Tractatus 13, whose title relates to the position it holds in the first book of Wyclif’s Summa de ente. They are puzzling references, since the first book of the Summa is made up barely of seven tracts. In this paper I argue that the three references are actually linking devices to the final section of the De ente praedicamentali. Moreover, I maintain that, at (...) the time of the compilation of his De scientia Dei, Wyclif conceived the first book of his Summa as containing thirteen tracts, the last seven of which later collected under a single item. This allows for a broader and more consistent account of the order and dating of the De scientia Dei and other Wyclif’s writings. (shrink)

Deben entenderse, a mi parecer, dos principios normativos diversos, entre sí complementarios y ambos esenciales en tanto fundamentos de la democracia: en primer lugar, el igual respeto y valor que debe ser asociado a todas las diferencias de identidad que hacen de cada persona un individuo diferente de todos los otros y de cada individuo una persona igual a todas las otras.

ZusammenfassungEin Großteil der medizinisch und ethisch schwierigen Therapieentscheidungen betrifft kritisch kranke, einwilligungsunfähige Patienten und wird auf Basis des mutmaßlichen Patientenwillens getroffen. Das Gesetz kann hierzu nur allgemeine Vorgaben geben. Es ist für die behandelnden Ärzte essentiell, sich ein konkretes Vorgehen zu erarbeiten. Wie in der Praxis vorgegangen wird, ist bisher kaum untersucht. Ziel dieser Studie ist es, die Vielfalt der Herangehensweisen und Erfahrungen von Klinikern zum mutmaßlichen Patientenwillen zu erforschen. Wir führten semistrukturierte Interviews mit 18 Ärzten und elf Pflegekräften von (...) intensiv- und palliativmedizinischen Abteilungen eines Universitätsklinikums durch. Die Abschriften der Tonaufnahmen wurden mithilfe der Qualitativen Datenanalyse ausgewertet. Auf einer numerischen Ratingskala wurde erhoben, wie hilfreich die Kliniker das Konzept des mutmaßlichen Willens fanden. Die meisten Studienteilnehmer hielten das Konzept des mutmaßlichen Willens für sehr hilfreich. Zu ihrem Vorgehen berichteten sie, dass sie zumeist die nächsten Angehörigen befragen, zuweilen auch Professionelle und falls möglich die Patienten selbst. Gefragt werde nach früheren Äußerungen der Patienten, nach ihrer Lebenspraxis und -einstellung sowie ihrem aktuellen Verhalten. Benannt wurden auch zahlreiche Unsicherheiten und Schwierigkeiten psychologischer, sozialer, praktischer und konzeptioneller Natur. Der mutmaßliche Patientenwille wird, so unser Ergebnis, in der von uns untersuchten klinischen Praxis entsprechend den gesetzlichen Vorgaben ermittelt. Da jedoch zahlreiche Probleme berichtet werden, stellen wir konkrete Empfehlungen zur Ermittlung des mutmaßlichen Willens vor. (shrink)

In this paper we present the results of a simulation study of credence developments in groups of communicating Bayesian agents, as they update their beliefs about a given proposition p. Based on the empirical literature, one would assume that these groups of rational agents would converge on a view over time, or at least that they would not polarize. This paper presents and discusses surprising evidence that this is not true. Our simulation study shows that these groups of Bayesian agents (...) show group polarization behavior under a broad range of circumstances. This is, we think, an unexpected result, that raises deeper questions about whether the kind of polarization in question is irrational. If one accepts Bayesian agency as the hallmark of epistemic rationality, then one should infer that the polarization we find is also rational. On the other hand, if we are inclined to think that there is something epistemically irrational about group polarization, then something must be off in the model employed in our simulation study. We discuss several possible interfering factors, including how epistemic trust is defined in the model. Ultimately, we propose that the notion of Bayesian agency is missing something in general, namely the ability to respond to higher-order evidence. (shrink)

An application of Narrative Knowledge Representation Language (NKRL) techniques on (declassified) ‘terrorism in Southern Philippines’ documents has been carried out in the context of the IST Parmenides project. This paper describes some aspects of this work: it is our belief, in fact, that the Knowledge Representation techniques and the Intelligent Information Retrieval tools used in this experiment can be of some interest also in an ‘Ontological Modelling of Legal Events and Legal Reasoning’ context.
